Terms of sale
These terms govern every sale of Mola Mola products made through molamolapuzzle.com to consumers, within the meaning of the French Consumer Code.
Scope
Placing an order implies full acceptance of these terms, in the version displayed at the time of the order. They prevail over any other document.
Seller
The products are sold by Hélène Levard, sole trader (entrepreneur individuel), trading as Mola Mola, Résidence Les Hauts de Calvi, 20260 Calvi, France. SIRET: 947 821 997 00055. Email: hello@molamolapuzzle.com. See also the legal mentions.
Products
Mini puzzles of 99 pieces, 10 × 14 cm, and fine art prints. Each is made from an underwater photograph taken by Hélène Levard.
The product visuals shown on the site are mockups created from the final artwork files, not photographs of the finished products. In print, the colours of the puzzle and its box appear slightly darker than on screen, due to the differences between screen display and printed colours. This slight variation is normal and does not constitute a defect.
Not suitable for children under 3 years old. Small parts. Choking hazard.
Prices
Prices are shown in euros. VAT not applicable, art. 293 B of the French Tax Code (CGI). Shipping costs are shown before the order is confirmed and are charged in addition.
Prices may change at any time. The price applied is the one displayed when the order is placed.
Orders
The order is placed once the customer confirms it and pays. A confirmation email summarising the order is then sent. The contract is formed on despatch of that confirmation.
Mola Mola may refuse an order that is abnormal, made in bad faith, or where a previous payment remains unsettled.
Payment
Payment is due in full when the order is placed, by card through WooPayments, operated with Stripe. Card details are never held by Mola Mola.
Pre-orders are charged in full when the order is placed. Pre-ordered puzzles are despatched no later than the shipping date shown on the product page and at checkout, in the order the pre-orders were received. If the shipping deadline cannot be met, you will be informed by email and may cancel your order for a full refund for as long as it has not been shipped or, for orders collected in Calvi, for as long as it is not available for collection, without prejudice to your rights under articles L216-2 and L216-3 of the French Consumer Code.
Delivery
Mola Mola ships from Corsica, France, to the following countries: Austria, Belgium, France, Germany, Italy, Luxembourg, Netherlands, Poland, Portugal and Spain, with Mondial Relay (relay point or home delivery) or by hand-over in Calvi. Delivery times depend on the destination and are shown at checkout. Failing any stated date, Mola Mola delivers no later than thirty days after the contract is concluded. In case of delay, the customer may terminate the contract under articles L216-2 and L216-3 of the French Consumer Code.
Orders delivered outside the European Union may be subject to import duties and taxes, payable by the recipient.
Risk passes to the customer on physical receipt of the goods. If a parcel arrives damaged or incomplete, please report it to hello@molamolapuzzle.com within 3 days of receipt, with photographs of the packaging and contents, so a claim can be made with the carrier. This does not limit the legal guarantees described below.
Right of withdrawal
Under article L221-18 of the French Consumer Code, the customer has fourteen days from receipt of the goods to withdraw, without giving a reason and without penalty.
Withdrawal is exercised online, free of charge, with the withdrawal form (which includes the model withdrawal form), or by any other unambiguous statement sent to hello@molamolapuzzle.com. An acknowledgement of receipt is sent without delay by email. The goods must be returned complete and undamaged within fourteen days of that statement, to: Mola Mola, Hélène Levard, Résidence Les Hauts de Calvi, 20260 Calvi, France; return shipping is at the customer’s expense.
Refund of the full amount paid, including standard outbound shipping, is made no later than fourteen days after the customer informs Mola Mola of the decision to withdraw, using the original means of payment. Mola Mola may withhold the refund until it has received the goods back or the customer has provided proof of dispatch.
The customer may open and examine the goods to establish their nature and characteristics. Where returned goods show handling beyond what is needed to establish their nature and characteristics, the refund may be reduced by the resulting loss in value, as permitted by article L221-23 of the French Consumer Code.
Legal guarantees
Products are covered by the legal guarantee of conformity (articles L217-3 to L217-20 of the French Consumer Code) for two years from delivery, and by the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).
These guarantees apply independently of any commercial guarantee. Claims: hello@molamolapuzzle.com.
Complaints, mediation and applicable law
Complaints should be addressed to hello@molamolapuzzle.com. Failing resolution, the customer may refer the matter free of charge to CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France, https://www.cm2c.net.
These terms are governed by French law. The customer may bring proceedings before the court of their place of residence.
